According to an arrest warrant, Toviano is accused of engaging in sexual activity with a woman and recording it without her consent. Nonetheless, this won’t affect his participation for LSU in the 2024 college football season after being reinstated by Brian Kelly.

"He's back in football activities, and we'll kind of get him going again, back in the mix," Kelly said of Toviano. "Obviously, he's going to be a competitive player for us. He played for us last year, and we'll get him going as he works through his legal matters."

The sophomore cornerback was reportedly taken into custody on Jul. 21 after turning himself in to the authorities. This immediately placed a level of uncertainty on his college career at Baton Rouge. However, the latest development comes as a relief to him and the program.

However, the case is still under review according to East Baton Rouge District Attorney Hillar Moore. Javien Toviano's arrest warrant showed he admitted during an interview with detectives that he had used a hidden camera to record the sexual encounters.
