The FIFA Appeal’s Committee’s rejection of the Real Madrid’s appeal in respect of the transfer bans has had an unintended effect. As a consequence, Real Madrid would not be able to exercise the buy-back clause on their youth product and current PSG player, Jese.
Buy-back clause in a transfer agreement is primarily an advantage given to a selling club (Real Madrid) to be able to repurchase a player at a set fee. In recent years, Madrid has utilised this clause and brought back players such as Morata and Casemeiro after their stints at Juventus and Porto respectively.
The clause allows the parties involved to benefit from the situation, with both clubs making a profit on the asset i.e. the player. The player also stands to benefit as he gets more regular playing time and also knows that his performances won’t go unnoticed by the selling club. With Spain being one of the biggest exporters of domestic talent, it is natural for them to insert such a clause.
Jese joined PSG in the summer for a sum of around €23.5 Million. Initially, it was proposed that PSG take Jese on loan with a buy option. PSG rejected the said proposal and the French club ended up purchasing the player with a buy-back clause being inserted by Real Madrid.
The effect of the FIFA ruling by the Appeals Committee ensures that Real Madrid won’t be able to exercise the buy-back clause in Jese Rodriquez’s contract. The FIFA Disciplinary Committee had given the said transfer bans in respect to protection of minors, where the club were found guilty of violation of certain regulations in relation to ‘Status and Transfer of Players. Real Madrid was fined an amount of CHF 360,000 as well.
The initial ruling was imposed by FIFA’s Disciplinary committee in January but was temporarily lifted pending appeals, which allowed the club to sign Morata in the transfer window. Morata has been the only addition to the Madrid set-up so far in the recently concluded transfer window.
Real Madrid are currently top of the table in the La Liga having won their opening fixtures and ran out 5-2 victors over the weekend against opponents Osasuna.
