What are the charges against Darius McCrary? Actor denied bail after fugitive arrest while crossing into the U.S. from Mexico

Family Matters star Darius McCrary was denied bail when he appeared in front of a San Diego court on October 15, 2025, 10 days after he was arrested on re-entry into the US from Mexico on an out-of-state felony warrant. According to TMZ, McCrary's reps claim his arrest on October 5 stemmed from a warrant in Michigan due to a missed court appearance over failure to pay child support.

Darius McCrary's arrest was reportedly listed as a "fugitive arrest" as per online booking information. The judge ordered the actor to be extradited to Michigan to face felony charges dacuring the hearing on October 15, denying him bail as he was an alleged flight risk. He is currently being held at a downtown San Diego jail.

During the trial, prosecutors noted that the actor had previously been arrested for similar charges in 2015 and 2023. According to San Diego's ABC 10 News, they further alleged that Darius McCrary owed over $75,000 in child support to his child as of August 2024, adding that the amount was "substantially more" currently. Additionally, they also claimed that the actor's agent told them that he was in Mexico to buy real estate.

McCrary initially defended himself when he was arrested, but was appointed a public defender during the extradition hearing. During the hearing, the defender claimed that the actor was in Mexico to participate in a charity program called the Esperanza program, which aimed to help build houses.

The defender further alleged that McCrary accidentally crossed the border into Mexico because of "a mix-up [about] where to meet his partner for the Esperanza program," and was arrested by the U.S. Customs and Border Patrol upon his re-entry into the United States on October 5.

Darius McCrary reportedly has three children. According to Us Weekly, the child involved in this case is his son, who recently turned 18. His rep told the publication that the actor was not properly notified of the court hearing that he missed, which led to the issue of his warrant. The rep further claimed that the actor's team was “going to continue fighting Oakland County, Michigan, on repeatedly violating McCrary’s due process and rights.”

Darius McCrary was previously accused of "partially dislocating" his daughter's arm

In 2019, Darius McCrary finalized his divorce from his ex-wife, Tammy Brawner, nearly two years after she initially filed. According to People Magazine, the court granted Brawner full physical and legal custody of the couple's then three-year-old daughter, Zoey, and ordered McCrary to pay $1,366 per month in child support.

The court further ordered McCrary to attend alcohol/drug abuse and batterers’ intervention classes within a year. The actor was also granted visitation rights to see his daughter every Sunday between 11 am and 5 pm, under the supervision of a designated family member, for a total of 10 visits. After completing this, he would be allowed unmonitored weekly visits.

Tammy Brawner first filed for divorce in 2017, citing "irreconcilable differences." Additionally, Brawner brought up her fears for her daughter's well-being in another court filing. According to The Blast, she alleged that Darius McCrary “partially dislocated” Zoey’s arm during an incident in March 2018.

Brawner claimed that McCrazy grabbed their then two-year-old daughter by the arm when he was taking her to the bathroom. However, McCrary denied this claim at the time and said he "grabbed one hand to lift her up and immediately grabbed the other." Zoe was diagnosed with Nursemaid's Elbow, a common injury among young children and toddlers.

According to the filing, Brawner also claimed that McCrary would give interviews "that I [Brawner] have been telling and coaching our 2-year old daughter to lie and say that 'dada hurt her.'" She further alleged that the actor was not attending his co-parenting classes with her, saying:

"I cannot co-parent by myself. I have gone above and beyond to parent with Mr. McCrary but he appears to be too bitter and too much of a tyrant to parent with me."

Darius McCrary has a court date reportedly scheduled for November 14, 2025.
