Gisele Bundchen and Tom Brady are divorcing after 13 years of marriage, but did they sign a prenuptial agreement before they walked down the aisle? They both had successful careers before getting married and made a significant amount of money. So you'd expect that they would have been advised to by their legal counsel.

In September, a source close to the couple told Suggest.com that Bundchen was being advised that she should revise the current prenuptial agreement. Which points to there being a contract in the first place. The original was straightforward in who would get what assets and how much. However, since Bundchen's net earnings have been less than Brady's in the last few years, she would be entitled to more if it was changed.

“The current prenup is pretty ironclad and lists how everything will be divided should they break up, but it needs to be updated, and it can be if both parties agree. Gisele is rich in her own right, but her friends are telling her she’d be nuts not to revise their prenup, and she’s likely to listen to them.”

In Tom Brady's official statement on Friday morning, he referred to the divorce as being finalized, although Bundchen had just filed the same morning. This could indicate that a prenuptial agreement was in place and that everything was already decided on and it 's just a legal formality at this rate.

What is a prenuptial agreement?

A prenuptial agreement, or "prenup" as it is commonly referred to, is a contractual agreement between a couple before they marry. This legal document is used to protect both parties if a divorce does occur. The prenuptial agreement also protects each person from any debts that the other person may have accrued before the marriage.

How does a prenuptial agreement work?

A prenup is a legal document signed by both people in the relationship. In order for a prenup to be legal in the United States, there are some requirements. Both have to be honest about the assets that they have listed in the contract and both must voluntarily sign it and not be forced to do so.

It must be in writing and signed in front of witnesses and often notarized for validity. A prenuptial agreement doesn't include child custody issues or any regulations as to how any children will be raised if a divorce does occur.

In the written document, both people list their assets, both physical and monetary, and how they will be divided if the marriage ends. The prenup typically includes real estate, businesses, stocks, inheritances, cash and other assets. In most cases, the couple will split their assets by who possessed them prior to their marriage. They then split what was acquired while married.

How would Tom Brady and Gisele Bundchen's prenup work?

Both Tom Brady and Gisele Bundchen had significant investments and assets before they married, so they would likely each keep all of those. The only decisions that will need to be made are the property and investments that they purchased together, as well as child custody.

In regards to the $375 million broadcast deal that he signed with FOX Sports, that should be off limits. The deal won't be mentioned in the prenup and he is yet to begin earning it as the deal starts after he retires.
